1. Who we are and what these Terms cover

These Terms of Use ("Terms") apply to the website headkeysoftwaresolution.com (the "Website") and to the apps we publish (each an "App"). The Website and Apps are operated by Headkey Software Technologies Private Limited ("Headkey", "we", "us"). By using the Website or an App you agree to these Terms. If you don't agree, please don't use them.

Each App also has its own Terms of Service, Privacy Policy, Cookie Policy and Refund Policy, shown inside the App. Where an App's own terms differ from these Terms, the App's terms apply to that App.

2. Eligibility

You must be at least 18 years old, or the minimum age stated in the App, and able to enter a binding contract under Indian law. If you use an App for a business, you confirm you are authorised to act for that business.

3. Our services and early access

The Website describes Headkey's software development and digital marketing services and our apps. Most of our apps are in development or early access. Features, plans and prices can change before launch, and we may add, change or withdraw features with notice where the law requires it.

4. Accounts

Keep your login details safe and tell us at info@headkeysoftwaresolution.com if you think someone else has used your account. You are responsible for activity on your account. You can delete your account in the App or at headkeysoftwaresolution.com/delete-account.

5. Acceptable use

You must not:

• break any law, or infringe anyone's intellectual property, privacy or other rights;
• upload unlawful, harmful, harassing, hateful, sexually explicit or misleading content, or anything that harms children;
• try to access accounts or data that aren't yours, probe or attack our systems, or get around rate limits or security controls;
• scrape, copy or resell the service, or access it by automated means other than features we provide;
• use AI features to create spam, malware, or deepfakes of real people without their consent, or anything that breaks our AI providers' usage policies.

6. Prices and payments

Current prices are on our Pricing page, and each App shows the exact price before you pay. Prices in Indian rupees are inclusive of GST. Prices in US dollars are charged in US dollars, and your bank or card issuer may add fees or taxes. Payments are handled by our payment partners (for example Razorpay, Stripe, PayPal, the Apple App Store and Google Play) under their own terms. We don't store your full card details.

Some plans renew automatically at the end of each billing period until you cancel. Others, such as passes, credit packs and boosts, are one-off purchases that don't renew. The Pricing page and the checkout screen say which applies. You can cancel a renewing plan at any time in the App, or in your App Store or Google Play account for store purchases, and you keep access until the end of the period you've paid for. Refunds are covered by our Refund & Cancellation Policy.

7. AI features

Some Apps use artificial intelligence from third-party providers. AI output can be wrong, incomplete or out of date. It is not professional (legal, medical, financial, tax or investment) advice. Check important information yourself and consult a qualified professional where needed. You are responsible for how you use AI output.

8. Your content

You keep ownership of the content you upload. You give us a non-exclusive, worldwide, royalty-free licence to host, process, display and transmit it, but only as needed to run the service for you and as described in our Privacy Policy. You confirm you have the rights to anything you upload. We may remove content that breaks these Terms or the law.

9. Our intellectual property

The Website, the Apps, their software, design, text and trademarks belong to Headkey or our licensors. You may use them only as these Terms allow.

10. Third-party services

We use third-party services such as payment processors, sign-in providers, hosting and AI providers. Their own terms may also apply to your use of them. We aren't responsible for third-party websites we link to.

11. Suspension and termination

We may suspend or close an account that breaks these Terms, puts others at risk or must be closed by law. We will tell you why unless the law or safety prevents it. You can stop using the service at any time.

12. Disclaimers

To the extent the law allows, the Website and Apps are provided "as is" and "as available", and we don't promise they will be uninterrupted or error-free.

13. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, such as loss of profit, data or goodwill. Our total liability to you for all claims relating to the Website or an App is limited to the greater of (a) the amount you paid us for that App in the 12 months before the claim and (b) ₹1,000. Nothing in these Terms limits liability that can't be limited by law, or your rights under the Consumer Protection Act, 2019.

14. Indemnity

To the extent the law allows, you agree to compensate us for reasonable losses and costs caused by your breach of these Terms or your unlawful use of the service.

15. Changes to these Terms

We may update these Terms. For material changes we will give notice on the Website or in the App before they take effect. If you keep using the service after that, the new Terms apply.

16. Governing law and disputes

These Terms are governed by the laws of India. Please contact us first at info@headkeysoftwaresolution.com so we can try to resolve any issue. Subject to your rights as a consumer, the courts at Bengaluru, Karnataka have exclusive jurisdiction.

Under the Information Technology Act, 2000 and its rules, and the Consumer Protection (E-Commerce) Rules, 2020, our Grievance Officer is:
